Terms of Use

These Terms of Use ("Terms") govern your use of the Job Portal platform available at jobs.thevisualizer.in and company.thevisualizer.in (the "Platform"), operated by Scalexbrain Mediaworks Private Limited ("we", "us", "our"). By creating an account or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.

1. What the Platform is

The Platform is an online marketplace that connects job seekers ("Candidates") with employers ("Companies"). Candidates can create profiles, upload resumes, search and apply for jobs and message employers. Companies can register, get verified, post jobs, review applicants, search the candidate database, and message candidates. Both sides can leave reviews after a completed hire.

We provide the technology only. We are not an employer, recruiter or staffing agency, and we are not a party to any employment or engagement between a Candidate and a Company. We do not guarantee that you will find a job, a candidate, or any particular outcome.

2. Who can use the Platform

You must be at least 18 years old and legally able to enter into a contract under Indian law. If you register on behalf of a company, you confirm that you are authorised to bind that company to these Terms.

3. Your account

• Give accurate, current information and keep it up to date.
• Keep your password confidential. You are responsible for activity under your account. Tell us promptly if you suspect unauthorised use.
• One person or company, one account. Do not impersonate anyone or create accounts to avoid a suspension.

4. Rules for everyone

You must not:

• post false, misleading, fraudulent or unlawful content, including fake jobs, fake profiles or fake reviews;
• harass, abuse, threaten or discriminate against anyone, or send spam or unsolicited promotions;
• collect, scrape, copy or resell data from the Platform, or use candidate information for anything other than genuine recruitment;
• upload malware, or try to probe, disrupt or bypass the security of the Platform;
• use the Platform in any way that violates applicable law.

5. Candidates

• Your profile and resume must be truthful. You choose who can see your profile and resume through your privacy settings.
• A Company that hires you is responsible for the terms of your engagement. Please be cautious of any employer that asks you to pay money to get a job — no genuine employer on this Platform should, and you can report it to us.

6. Companies

• New companies are reviewed before they can post jobs or access candidate information. We may approve, reject, request more information from, suspend or block any company at our discretion.
• Jobs must be genuine, lawful and accurately described. Jobs may be reviewed before publication and may be rejected or removed.
• You must not charge Candidates any fee for applying, interviewing or being hired.
• Candidate information you access (including resumes) may only be used for recruiting for your own genuine openings, must be kept confidential, and must not be shared, sold or used for marketing.

7. Messages and reviews

Conversations are tied to an application. Either party may block a conversation or report a message. Reviews may only be written after an application reaches "Joined" (a completed hire), must reflect your genuine experience, and must not contain abuse or confidential information. Reported messages and reviews may be reviewed by our moderators, and we may remove content that breaks these Terms. We do not remove reviews merely because they are critical.

8. Memberships and payments

• Candidate and Company memberships are one-time payments at the prices shown on our Pricing page. There are no renewals or recurring charges.
• "Lifetime" means for as long as we operate the Platform and your account remains in good standing. It is not a promise that the Platform will run indefinitely. If we ever discontinue the Platform, we will give reasonable notice.
• Prices apply at the time of purchase. We may change prices or plans for future purchases; this does not affect memberships already bought.
• Payments are processed securely by Razorpay. We never see or store your card, UPI or bank details.
• Memberships are non-refundable and non-transferable, as set out in our Cancellation & Refund Policy.
• Some features may be available only to members. Which features are included may change over time as the Platform grows.

9. Content you provide

You keep ownership of the content you upload (profile details, resumes, job posts, messages, reviews). You give us a non-exclusive licence to store, display and process it as needed to run the Platform and show it to the people you have chosen to share it with. You confirm you have the right to provide it.

10. Suspension and ending your account

We may suspend or terminate accounts that break these Terms, put others at risk, or are used for fraud. You may stop using the Platform at any time and can ask us to close your account by writing to thevisualizer09@gmail.com. Ending or losing an account for breach does not entitle you to a refund.

11. Disclaimers and limits of liability

The Platform is provided "as is" and "as available". We do not verify every job, company, candidate, resume or review, and we are not responsible for the conduct of any user or for any decision you make based on information found on the Platform. To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of opportunity, or loss of data, and our total liability to you for any claim is limited to the fees you paid us in the twelve months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

You agree to compensate us for losses arising from your breach of these Terms or your misuse of the Platform, including claims by third parties relating to content you provided.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above shows the latest version. Continuing to use the Platform after a change means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of India. Courts located in Gujarat, India have jurisdiction over any dispute, subject to any rights you have under applicable consumer protection law.
